A 29-year-old Forsyth man was charged with statutory rape and other crimes allegedly committed at the Union Hill Apartments on Nov. 27. According to his Forsyth police report, officer Jeremy Malone was patrolling the complex when he noticed a woman and several people upset in front of Apt. 8B. After Malone pulled up, a woman told him something needed to be done about James Zellner. She was so upset, Malone was struggling to understand her, so he went to the apartment to speak with Zellner.
While the officer was speaking with him, the woman told Malone that Zellner had slept with her underage daughter. Malone asked him what she was talking about, but Zellner wouldn’t answer his questions and kept stating that the apartment was his.
Malone went outside to speak with the daughter, but she was so upset she couldn’t answer his questions. She then told her mother she didn’t want Zellner to get into trouble. Malone returned to Zellner who remained uncooperative, so he was handcuffed and detained in a bedroom away from an escalating situation by his neighbors. After reviewing a written statement by the girl, officers felt there was enough evidence to charge Zellner with statutory rape, child molestation, and cruelty to children and officer Anais Benjamin took him to the Monroe County Justice Center. Inv. Thomas took the victim and her mother to the Care Cottage.
